Can anyone empirically tell me if I’m required to list dismissed misdemeanors on the OF-306 when the form only asks: “During the last 7 years, have you been convicted, been imprisoned, been on probation, or been on parole? (Includes felonies, firearms or explosives violations, misdemeanors, and all other offenses.) If “YES,” use item 16 to provide the date, explanation of the violation, place of occurrence, and the name and address of the police department or court involved.” I’m not trying to split hairs or be dishonest. I just want a black and white answer.

It’s simple: Did your misdemeanor occur in the last 7 years? If yes, provide the four required responses. If no, mark no.

The form does not make special note of dismissals.

The form is pretty black and white.

The 306 is the least of your concerns. Everything will come out on either the case papers, extra coverage questions, or fingerprints. Dismissed means nothing. There’s a 100% chance that whatever you did…that you dont think matters…will be brought up in your investigation. You dont have to technically list your dismissal on the 306 but you do have to provide it elsewhere. There are many reasons for dismissals that don’t involve innocence. For the purposes of your investigation dismissal is meaningless but if the word dismissed makes you feel better go for it.

I understand, but that doesn’t address the question.

HR doesn’t review the OF306.

Who does? The FSO? I’m trying to understand the process.

Security specialists. But that’s all you need to know.

As an applicant/subject, your job is to provide requested information and respond to further requests. It is not to understand the process.
