I’m joining the MI branch of the Army and they are saying since I have a citation for disruptive conduct for playing my music in my car loud I may not be able to join. It was originally a small personal marijuana charge because I was pulled over for my music. The found weed on my girlfriend. They charge us both. I hired a lawyer and they dropped my charge and gave me the disruptive conduct charge from my music. Please advise.
Your initial citation involves THC possession - it’s that aspect of your situation which will be problematic.
In such scenarios you MUST be upfront about all aspects - all of them. Never assume or rest assured that downgraded or dropped charges clears or excuses you of full reporting responsibility - it WONT!!!
Your investigation WILL obtain your criminal records which includes citations. Those details almost always contain the original charges or issues as well as the final disposition. Also keep in mind, any issue involving fingerprints will usually be uploaded into the FBI database. While you may believe your situation is expunged because you went to your local courthouse to have an issue removed from your record, unless you take the additional step to make sure the information is removed from the FBI database, the issue is not fully expunged- your fingerprint record will contain that information and you are not relieved of the responsibility to report the issue.
Drug Scenarios like this involve three aspects of concern: illegal drug use/involvement (yes, THC is STILL illegal on the Federal level), criminal issues, and honesty issues.
You need to be upfront with disclosure- you were involved with THC possession, whether it was your weed or not is only an aspect of the scenario. Sure your friend may have been the responsible party, but you got stuck and you need to own that first and foremost. The details following you taking ownership of the issue will either be your mitigation or your conviction.
I was very upfront. Even my waiver tells the story. Thank you for your very detailed response. The case is closed and I was not found guilty of weed possession, it was only my music. Which I had to pay a citation for violations & penalties disruptive conduct.
