Can the FSO disclose info from an sf86 form to anyone else in the company?

What can an FSO share with other departments like HR?

I took a glance at some federal laws like the NIPSOM. See part d of 32 CFR § 117.10 - Determination of eligibility for access to classified information for contractor employees. | Electronic Code of Federal Regulations (e-CFR) | US Law | LII / Legal Information Institute

“Not share information from the employee’s SF 86 within the entity and will not use the information for any purpose other than determining the adequacy and completeness of the SF 86.”

Can anyone verify this? Do FSOs just review for accuracy and completeness?

It’s a great question. I had an active duty military officer who was the security officer ask me that same question once. I didn’t have the answer. He was required to view SF’s of the members he supervised and had seen current drug usage revealed. He wasn’t sure what he could do with that information? Some of these troops were in sensitive postions regarding medical and aviation maintenance. I’m sure if any security officer sees any sort of issues related to child endangerment they have an obligation to report, but no one seems to know about the other things. I could never find an answer anywhere.

32 CFR 117 only applies to contractors. It does not apply to military or federal civilians. Yes, contractor FSOs are prohibited from sharing information from an SF86 with others in the company. However, what if it’s a very small company where the HR manager is also the FSO? And do all of the people follow all of the rules all of the time,

Does the FSO even have a copy of your SF-86? If you fill it out in NBIS eApp doesn’t it go directly to the investigators bypassing your company?

That’s what I thought. I think the FSO can release it or something but I don’t think the FSO can see it. Maybe they can just see it has been completed with no errors?

I say this because a few years back, when the backlog was really bad, we had to put some comment in there that supposedly would help and they had no way of verifying we did it.

I can’t speak to the form bypassing anyone, doesnt someone have to review it for accuracy and completeness so the gov doesn’t kick back? I also don’t know if a copy is retained. Multiple sites and threads give conflicting info

The online app (used to be called eQIP, think they changed the name) checks for completeness… but only you can check for accuracy :slight_smile:

FSO reviewed my form as part of the process to submit the package for a contract. They are not supposed to share it with anyone outside of their own security team (esp with all that PII). But you know… SHOULD not <> WILL not

I would recommend READING the fine print on the SF86, particularly the section that discusses “Disclosure Information” It truly amazes me at how many people sign this form having NEVER read what in the world they are signing.

Yes we can read your 86 that you submitted and we have to for accuracy. No we are not supposed to use the information for any other purpose. We are asked on occasion what was in the 86 that is holding up the process. We only disclose a coding system that does not reveal anything that can be used against you. I work for a federal contractor that’s over 11k strong.
