Dismissed small claims still need to be reported?

Had some work done to my home. Person failed to meet the standards so we both signed an agreement that we would get our money back and go our separate ways. Got my money back from the credit card company but it wasnt the full agreed upon amount. Guy says it is and is upset I wont take down my reviews even tho he is $220 short on contract obligations and put in a small claims case against me for breaching contract I guess.

Plan to just bite the $220 and remove the reviews for him to get the case dismissed as I rather not deal with a headache over $220… But my question is I haven’t received anything yet for a court summons so if i can get him to put in a dismissal do I still need to even advise my FSO? Should I just to be safe?

I think the reporting threshold is $500 but not 100% sure. I’ve never heard of a small claims case causing issues so can’t think of any reason not to report. Wait for some investigators to chime in.

Yes you need to report it. Anything that is required to be listed on the SF86 needs to be reported. If you don’t report it, when your next investigation roles around they will want to know why this was not reported. The SF86 says “In the last 10 years have you been party to any public record civil court action not listed elsewhere on this form?” The questions DOES NOT put limits on that question. There is no monetary limit, no outcome exceptions, nothing. ALL civil court actions within the coverage period must be listed. No exceptions.

I think I was thinking of financial disclosures for limits. Your answer make much more sense.

The main thing Im stuck on is I havent received a summons yet. The guy said he submitted a case on Facebook. My wife texted him and got him to say he would get it dismissed now? And based on Google that means it will have been terminated and we will never receive a summons. So, do I still report even if its been terminated / what if he just made it up to begin with to get what he wants?

Sorry if im over analyzing. I don’t care to report it I’m just kinda confused since he just said he submitted one and that he is getting it terminated now.

You should be able to log into your local court system, do a search by the guy’s name (or company name) and your name. If a case has been filed, even if dismissed it should still pop up. You can also go in person and speak to the Civil Courts clerk for assistance.

If a case has been filed, it will need to be reported, as HR2C stated.
