The Chapter 13 trustee says I have no disposable income to work the plan. This is after adjusting my withholding. The Chapter 7 when I had applied was before the adjustment to the withholding so I had too much disposable income.
You had disposable income while not paying your bills and letting your debt go to collections? That will be tough to mitigate.
Congrats on your 2nd chance. In my opinion, your initial termination was probably illegal and that’s why they offered a 2nd chance. An FSO can not pre-adjudicate a clearance eligibility, regardless of their experience, training, etc. Only an authorized federal adjudication facility can grant or deny a clearance eligibility. I believe that the FSO took your info to HR and the PM who considered that you would not get an interim with a felony conviction and could not put you on the job fast enough to satisfy the government customer. Your reinstatement is the good news. The bad news is that your confinement for 18 months means that your case will fall under the Smith Amendment/Bond Amendment of the federal clearance process. That means the adjudication facility will have to issue a meritorious waiver of the adjudication guidelines for you to have a Secret eligibility. From your info, I believe you should receive a waiver, but it could take a long time. Good luck.

It’s ok. People in his position are exactly some of the people I have to deal with in day to day life when I have to disclose things. Anybody that meets me wouldn’t know or believe it or the things I’ve gone through unless I tell them.
Not to mention my felony is one of facts and not intent. Intent goes a long way when it comes to how events unfold…

To add, I don’t understand your beef with me. To my knowledge, I’ve posted nothing derragatory towards you. From what I understand, you’re concerned with negative items on your credit report and how they’ll impact your PR. With respect to that, I think I just responded to your post stating that having discretionary income while allowing debt to go to collections is a financial consideration that will be difficult to mitigate. Furthermore, financial considerations are the leading cause, by a considerable margin, of clearance and public trust revocations.
On a side note, I don’t like to see anyone get fired and I hope that does not happen to you as a result of your upcoming PR. I can’t imagine the hopelessness of your situation and the persistent anxiety that comes with it. Best of luck, mate!
Let’s remember, in these discussions, just how statistics work:
The fact that financial issues are, by far, the most common reason for denials, doesn’t mean that they are more important to adjudicators or more difficult to overcome than other problems. It simply indicates that far more people have financial issues than have foreign contact issue, drug or alcohol problems, criminal histories and everything else that can get you denied.
In fact, my guess is that over the last few years, it has gotten easier to get cleared with financial issues, if you have or are working on them. This is because, coming out of the national financial issues of the last 10 or 12 years, many, many, good, reliable, honest, people have gotten into financial trouble despite their best efforts to avoid it.
In my long life I have learned that being kind to others is more important than anything else. If we were to do a analysis of all of your postings under dave019 and now 018, a pattern begins to become apparent, your salty about clearances and people that have them. I suspect that you are in private industry because perhaps, maybe, your not clear able, have lost your clearance? I put my faith in something greater than myself so no matter the outcome, I will be fine.
@nrc2112 - You’re right. I can’t get a government job. For whatever reason the clearance god’s aren’t willing to accept all of my terrible misdeeds! Lol, just kidding, I moved to the private sector from public sector a while ago for more money. In my line of work, the money is in the private sector, however, I used fed employment to forgive student debt I had, worked out great.
Joking aside and moving forward - I’d like to apologize if I offended you in any way. I truly do hope the best for you and your situation. Honestly, I’m not being sarcastic or intentionally rude when I express empathy. It must suck and be terribly bothersome to have to wait everyday for some bureaucrat to issue you an SOR that in all likelihood could destroy your life. Again, best of luck.
