No worries if this isn’t allowed, but I’m an applicant wondering if they are looking for victim reports in police records in addition to criminal history and such. I was robbed & assaulted a year ago and that’s not a huge deal in itself (I did nothing criminal) but they will see that I was pretty tipsy walking alone, I stopped to talk to the guy instead of just walking by, and I’m afraid they’ll find me too irresponsible. (You don’t have to tell me that was stupid…I obviously know.) If they just know it happened, fine, but the details are kind of ugly.
Just criminal history not victim statements. The situation would only be asked about if a source brought it up and details were needed to clarify what the source reported. This is not asked about on an SF85 or an SF86.
Oh, yeah, I know it’s not required anywhere on the 86. But when they do the local law checks everywhere I’ve lived, it seems like the police might just hand that over since my name is on it even as a victim.
It really depends on the law enforcement agency and how they handle it. Some (most) will only provide records where the name on the release was an accused. Some others will provide every record that person is associated with (victim, witness, etc). There is no way to know.
It depends on the agency you’re getting a clearance with as to whether they regard victim info as pertinent. Some agencies are stricter than others.
In my area all contact with police, even victim contact, is provided during law checks. For instance, a former security guard at CVS might have 40 police hits due to each time the police show up they took his name but beside his name it might say subject (anyone present at the scene) or victim rather than arrestee.
