Arrest and Public Trust (moderate risk) clearance

I received a HRPT about a year and half every being arrested. That was 2008.

Hello, I have a quick question. I was recently offered a position through a subcontractor to work for the federal government in the department of commerce as an staffing assistant. In 2015 I was charged with theft and was given deferred adjudication. I have completed the probation and the case is closed out… will this pose a threat to getting a public trust clearance… I have been worried about this and scared to take job to save embarrassment.

If that was your only offense and it was a misdemeanor as long as you disclose all required information it is not an issue.

Thank you for the response. It was a felony not a misdemeanor… so that would be an issue, I’m assuming.

It has been 6 years since the arrest so time mitigates. Just depends on the position and agency stance.

I’m back again with.another question… I have completed the eqip and everything. Last week a security officer reached out to me with credit memo. Took care of the couple items and responded back to the security officer. After responding, the next day my manager let me know I was cleared. But I was contacted by investigator to set up interview today. So I guess my question is…. if you are cleared for public trust, why would I need interview still?

Because your sponsoring agency needs additional information before adjudicating your public trust suitability.

Public trust applicants are often allowed to start work before their background investigation is completed because the short term risk is low.

I’m looking for anyone with experience or knowledge to answer my question. I already received conditional offer from federal BOP and recently filled out my EQip. In November of 2020 I was arrested for DUI and placed on ARD program in PA but was never convicted. After completing the program all my charges were expunged and have been for close to a year. I was wondering if this will affect my chances of gaining public trust I require as a possible corrections officer, or if because it is expunged and I disclosed it i should be fine.

Also a reckless driving dropped to improper driving 2018.

Am I still eligible to obtain public trust
