Tier 1 VHA Suitability and Past Issue

I’m an incoming HPT at a site that has a VA hospital and will be undergoing a Tier 1/SF-85 background investigation (low risk/non-sensitive) around May 2026. I have one significant (resolved) past issue that I would like to share and hopefully get feedback on:

In Jan 2023, I had a complicated physical and verbal altercation with my then-girlfriend and was charged with 2 counts of felony domestic violence. This situation was litigated for a year, along with a separate civil RO, during which I started a previous medical residency and was subsequently placed on admin leave. In May 2023, I stipulated to a 3 year civil RO to avoid a hearing and essentially pled the fifth (could not keep pushing this hearing date back to coincide with the criminal case timeline so agreed to an order without hearing while having the judge state that no finding was made). In Jan 2024, I pled No Contest to both charges, and was sentenced to 6 months jail (90 days max to be served, 72 days actually served), one year of DV classes, one year of psychotherapy, 45 days of community service, and 4 years of probation. a 10 year protective order was also issued. I was terminated from my residency program in Jan 2024 due to the off-duty criminal conduct as well.

In January 2025, I completed all requirements of my probation and my felony convictions were reduced to misdemeanors. In June 2025, my probation was terminated early and my convictions were vacated and expunged from my record. By this time, some of my ex’s crucial inconsistencies in her story have shown and I was able to secure strong support from the DA. Of note, the Medical Board of CA reviewed all aspects of the case (police reports, mitigation, etc.) and issued me an unrestricted medical training license in July 2025.

I take full responsibility for my role in this situation. I have not had any prior arrests nor any new arrests since this incident. My ex girlfriend and I have not been in contact since the initial arrest. I understand how serious domestic violence is and I definitely do not make light of my past situation.

With that said, I have been working diligently to learn from this situation and show that these past charges are not representative of my character. How can I best portray this situation during a background investigation?

For Secret/TS, I think you need at least a year to mitigate. Not sure when the clock starts (when incident occurred or when charged or when convicted/sentenced). You may need more time. That said, not sure if it would be that problematic with a T1.

What was the maximum sentence you could have been sentenced to? Are you permanently barred from purchasing a firearm now? This will follow you for the rest of your life and should server as a cautionary tale to others. It would have been cheaper and less damming to get caught with a prostitute than get a domestic violence arrest. technically up to 4 years for each count. No firearms for life unless US vs. Rahimi gets revisited and overturned at some point. A painful lesson indeed.

Thank you for your response! By the time I’ll be going through the background investigation, it’ll have been about 3.5 years since I was charged and 2.5 years since the convictions. I’m hopeful that my lack of any other priors/arrests, completion of all probation terms/mitigation, early termination of probation and expungement are all looked at favorably in the whole person concept.

I can’t think of anything I could do to further mitigate this situation other than continuing to distance myself from the arrest through time and good conduct.

Wow, that is tough and I feel for you. I would never have pled out to that, but would have rolled the dice on a jury trial. But I am a real stubborn asshole too. Problem with trials is you never know how they go. The criminal justice system in America is one you want to stay far away from.
