Misdemeanor Diversion

I am currently in suitability review for the DOS and my TS clearance was favorably adjudicated. However, after that happened I was arrested and charged with a class 2 misdemeanor. The prosecution offered a diversion program where the charges would be dismissed and the case would be sealed once I complete the program (just counseling). I’m wondering how this will affect my suitability review and ability to have my clearance renewed down the road, any insight would be helpful. Will the diversion program be considered good mitigation? What else can I do to help no jeopardize my future employment?

Hopefully this was reported already is the biggest thing. Once they get a CE check it will look much better if you already reported this to them vs if you have not.

Completing the Diversion Program is a mitigating factor. If this was a one time incident with no prior similar conduct it should not affect your eligibility. You should have reported this incident to the DoS Security Office, as the arrest will get picked up by Continuous Vetting and the FBI Rap Back checks.
