Suitability issue after the incident closed

One federal agency has notified me to wait two years before applying. For another federal agency, there was no official notification, likely due to suitability concerns. To err on the side of caution, should I wait two years from now to apply for CAC/PIV clearance?

For context:

  • The case was filed in 2022 and resolved in March 2024 with probation before judgement - 5 year probation (already 1 year done, and ask early termination after 1 year)
  • The position I’m targeting is likely Tier 1, which involves a 5-year investigation window.

Do you have any advice or thoughts on this approach,. such as wait until 2027 (after 5 years from the arrest)?

If you already had a clearance or PIV and lost it due to this, I think the clock starts from the date of denial or revocation. Otherwise, I would guess it’s the date of the judgement. You also might need to wait until your probation is completed if that’s longer than the 2 year period.

If my 2022 offense is still under investigation for Tier 1 after two years (stlll in 2026), could it result in the denial of my CAC/PIV application, even if I completed probation before applying?
