FAA Suitability (Tier 2 / Public Trust) with Recent DWI – What Are My Chances?

I’m looking for some insight on FAA suitability for a Tier 2 (Moderate Risk / Public Trust) position.

I’ve fully disclosed everything during pre-screening and on my SF-85P.

Timeline:

  • Arrest: October 2025

  • Court: January 2026

  • Outcome: 1-year unsupervised probation (PBJ – Maryland)

At the time of the incident, I was Active Guard/Reserve. Since this type of position counts as a “favorable action,” I had to step down from my full-time role after reporting the incident to my chain of command the same day. A suspension of favorable actions (FLAG) was initiated, which I also disclosed on the SF-85P.

Current Situation:

  • Still on probation (unsupervised)

  • Court disposition was about 4 months ago

  • Still serving part-time in the military

  • TS/SCI clearance is still active on the military side

Main Concern:
Since my probation is still ongoing and the incident is relatively recent, what are my chances of passing FAA suitability?

I’ve been fully transparent and compliant with everything, but I’m unsure how heavily the “recency” factor and open probation will weigh against me.

Any insight or similar experiences would be appreciated.

Since you still have a TS/SCI, have you received a LOI regarding your DUI or are you still pending an adjudicative action for TS/SCI?

Your chances are not good. The government does not like DUI’s and that falls under eCFR: 5 CFR 571. It explicitly states “Criminal conduct” and “Excessive alcohol use, without evidence of rehabilitation, of a nature and duration that suggests the applicant or appointee would be prevented from performing the duties of the position in question, or would constitute a direct threat to the property or safety of the applicant, appointee, or others;”

A DUI falls into this category and you are still on probation. You have a low chance of passing suitability, and consider yourself lucky that you have not had your clearance revoked.

I don’t know where am I sitting at the TS/SCI side, but I sent the Statements through my military chain of command.

I received LOI for suitability, and now im waiting for interim approve/denial, Since Im on probation, I think I will not be able to get interim..

do a rehab program. As long as you don’t have any other issues, in most cases, you should be good after your year of probation is done. Only caveat is if you are at IC agency. That might need 1 more full year to mitigate.

I already did the 26 sessions of rehab before I went to court, and at the LOI i said last time I drink alcohol was Jan2026.

I already got interlock and never had violations.

I see that my chances are really low to pass, I still hope I can make this happen.
