I have an active TS and am working on an FT job for a company. Somehow, my employer is maintaining it, I’m not currently working in a TS project. I’m getting a part-time (1099) opportunity with another agency that requires a secret clearance. Is it possible to accept that job without the knowledge of my employer? Any pointer would be greatly appreciated.
I think you are asking the wrong question. Disclaimer: I am not a lawyer, so I have no knowledge of labor law The question would be, is it ethical? If you are talking about working the 1099 work different hours than your full-time job, then there shouldn’t be an issue as long as you report it to your security manager. I believe when holding a TS, all outside employment has to be reported. If you are considering doing part-time work during you full-time work hours, that might be an issue. If you are getting paid for a particular time space by employer A, your time should not be going anywhere else. It would be no different than if you chose to play golf during you full-time work schedule. Also, it is “possible” to not have your employer know at the current time, but when time comes again to complete you SF86 for FT employer, will you just omit that 1099 employment? That would be falsification, and that is not a good look in the security clearance world. Just my two cents.
Your current FT employer may require that you disclose additional employments. That should be your first question.
If you cross that hurdle and decide to go for it, I would keep meticulous records to avoid any hint of time fraud.

Thanks for your response. The PT job is only 15-20 hours that I can do any time I want (off hours and week end).
Your clearance REQUIRES you report outside employment. If you don’t want to jeopardize being able to hold a clearance, I don’t suggest you try hiding information.
