Hello I’ll try to be brief. Submitted the sf86 for a TS clearance and disclosed fully disclosed 2 duis from 12+ years ago. When it comes to the interview how deep of a rabbit hole will I need to go down regarding the specifics of each one. Will an investigator want contact info or want to reach out to anyone I was with at the time of arrests? Additionally I had a ‘injury to cohabitant arrest’ but never charged over 10 years ago. I don’t need to disclose on form but I know the arrest will still pop up . Im prepared to fully discuss the situation but will the investigator want to contact the cohabitant? When ever a Subject lists any issue on their SF-86 investigators have to resolve the issue no matter how long ago it happened. The who, what where, when why, how, who knows of each offense and then will it ever happen again. Since the DUIs are both a police issue and an alcohol issue, questions will be asked to resolve both issues.
Regarding your “injury to a cohabitant arrest”, was it a felony arrest? If it was, it did need to be listed on your SF-86. If it wasn’t be prepared to talk about anyway it anyway as law checks done most likely will find it and the agency requesting the investigation may want to to know more about it.
A quick thought here - depending on state/city/municipality, DUI charges can vary. If you just listed the disposition (you weren’t this specific in your note above) I would obtain the court records, all charges, and the disposition of each charge. Also - any probation paperwork noting completion, fines, etc - have all of that information handy. Yes - the investigator will go get all of that too - but YOU need to be prepared to answer questions honestly and completely - and the best way to do that is having the actual paperwork in front of you to avoid any confusion.
You will also likely be asked about the repeat offense, what you have done since. Time - as you mentioned- is but only one mitigation to the repeat offenses. Be prepared to also speak to if you still socialize with the same people/crowd, what in your life has changed since then (marriage/kids), current drinking habits, etc. This is all about assessing the likelihood of recidivism and honesty. I agree with all of this. I have known people to get arrested and still keep the clearance, but it all depends on the situation. If you were arrested and never charged but you still committed the offense then they will still factor that into your overall character. DUIs can be a tricky one as it could go either way. The best thing would be to show how you have changed as a person since then. They were both a long time ago. People make mistakes. I would put weight onto what you have done since then to show why you can be trusted.
